By using the site, uploading an image, or purchasing a service, you agree to be bound by these Terms of Service. These Terms apply to all users of the site.

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks and changes to conform to technical requirements. Credit card information is always encrypted during transfer.

3.1 Accuracy: You agree to provide current, complete, and accurate purchase and account information.

3.2 Payment: Payments are processed securely through third-party providers. By submitting payment information, you authorize us to charge the applicable fees.

3.3 Modifications: Prices are subject to change without notice. We may modify or discontinue the service (or any part of it) at any time.

4.1 Digital Assets: Paid digital downloads are delivered electronically.

4.2 Physical Goods: Physical products such as prints and apparel are produced on demand. We cannot guarantee that your monitor's display of colors will perfectly match the physical product.

4.3 Shipping: Delivery times are estimates. We are not responsible for delays caused by carriers or customs.

5.1 Ownership & Rights: By uploading any image, photograph, or content ("User Content"), you represent and warrant that:

• You own the User Content or have all necessary licenses, rights, and consents to upload it.
• The User Content does not infringe the copyrights, trademarks, or intellectual property of any third party.
• You have the express permission of every identifiable person in the image to use their likeness.

5.2 Biometric Data Consent: You acknowledge that automated processes may analyze facial features to generate artwork. By uploading an image containing a face, you provide explicit opt-in consent for that processing.

5.3 Prohibited Content: You may not upload images of public figures without documented consent, copyrighted artwork or trademarked logos, or material that is defamatory, obscene, or depicts minors in any capacity.

5.4 Indemnification: You agree to indemnify and hold harmless Last Best Place Inc. from any claims, damages, or legal fees arising from your breach of these warranties.

6.1 Service Nature: Portrait services use artificial intelligence to create artistic portraits. Results are subjective and may vary.

6.2 Personal vs. Commercial Use: A purchase includes the right to use generated artwork for personal, non-commercial purposes. Business branding, advertising, or resale requires a commercial license.

6.3 AI Limitations: We do not guarantee that artwork will be unique or that similar results will not be produced for other users.

Due to the digital nature of AI generation and the immediate computing costs incurred, all sales of digital credits and downloads are final.

Sales of physical prints and merchandise are also final, as each item is custom-produced. If your print arrives damaged, defective, or with a clear production flaw, we'll send a replacement at no cost. Contact us within 14 days of delivery with clear photos showing the issue. Replacements are provided in place of refunds.

You are prohibited from using the site or its content for any unlawful purpose, to reverse engineer or extract AI models, or to create deepfakes or deceptive content.

In no case shall Last Best Place Inc., our directors, or employees be liable for any injury, loss, or claim arising from your use of the service. Our liability is limited to the maximum extent permitted by law in the State of Texas.

These Terms shall be governed by the laws of the State of Texas, USA. Any disputes shall be resolved through binding arbitration in Dripping Springs, TX.
